A Fitness for Duty Evaluation (FFDE) is a formal and specialized examination conducted on an incumbent employee under specific circumstances. It arises when there is objective evidence indicating the employee may be unable to safely or effectively perform a defined job, and there is a reasonable belief that a psychological condition or impairment may be the cause. The primary objective of an FFDE is to ascertain whether the employee can perform essential job functions safely and effectively.

In simpler terms, an FFDE serves as a forensic evaluation aimed at helping employers comprehend performance issues related to the mental health of an employee. It also serves as a crucial decision-making tool, guiding employers on the appropriate course of action.

In situations where documented performance problems, such as complaints, declining productivity, absenteeism, mistakes, accidents, or threatening behavior, are evident, and there is a suspicion of a psychological impairment (such as depression, substance abuse, anxiety, anger issues), it becomes prudent to consider a Fitness for Duty evaluation. Moreover, if there is a concern that the employee may pose a threat to themselves or others, seeking a consultation is crucial. A pre-referral conference is the initial step to explore the legal, clinical, and forensic aspects of an FFDE. Should you decide to proceed with an FFDE, thorough documentation and records for the employee in question are essential.

It is important to note a significant distinction between therapy provided by a mental health provider and an evaluation by an FFDE evaluator. While an FFDE evaluator is likely a mental health practitioner, their role is not to provide services to the individual being evaluated. Instead, they are highly trained evaluation experts who assess the employee in a scientific and impartial manner. Expectations of the FFDE evaluator should not include "fixing" the employee. In contrast, a therapist, also a mental health practitioner, serves in a supportive role and advocates for their patient. It is not reasonable to anticipate a fair and impartial determination regarding the employee's psychological fitness to continue working from the employee's therapist.
