
Post-Conviction CVSA
According to a 2002 report, "The Current Role of Post Conviction Sex Offender Polygraph Testing In Sex Offender Treatment," the polygraph is unsuitable for individuals who are psychotic or have borderline or below-average IQs. Moreover, it fails to work effectively with sociopaths or psychopaths and is susceptible to easily accessible countermeasures. These limitations can result in false-positive, false-negative, or inconclusive results, undermining the accuracy of the monitoring process. Given the diverse range of personality types among sexual offenders, relying on a system with such vulnerabilities risks allowing many offenders to evade detection.
A Resource for Sex Offender Convictions
At Trustonics not only do we use the CVSA technology for pre-employment we also use it in the post-conviction monitoring of convicted sex offenders while in treatment or in a maintenance program, a convicted sex offender may be given a preliminary truth verification exam to assess the psychological state of the individual and obtain information such as sexual history. Monitoring examinations are then used to ensure that the sex offender isn’t engaging in high-risk behavior and is complying with treatment protocols and parole conditions. While the polygraph, a commonly used tool in post-conviction monitoring, possesses inherent flaws that hinder its effectiveness in sensitive interviews.
In contrast, the Computer Voice Stress Analyzer (CVSA) in the hands of a skilled examiner remains unaffected by countermeasures and is not restricted by the same limitations concerning personality types or psychological conditions. Consequently, the CVSA stands out as a suitable tool for tracking the post-conviction progress of all candidates.
While the polygraph has been the traditional choice for truth verification, the CVSA's accuracy and user-friendly nature are gaining widespread acceptance. In 2014, U.S. Federal Court Judge Norman Mordue affirmed the CVSA's equivalence to the polygraph for monitoring sex offenders under supervision by the 2nd U.S. Circuit Court of Appeals in the Northern District of New York.
With the CVSA, there exists a greater opportunity to manage dangerous individuals through post-conviction interviews. These interviews enable parole officers to assess whether a sex offender is complying with the terms of their release, providing a more effective and reliable means of supervision.
